About

Ted Kelleher is an experienced attorney who focuses his practice on corporate, regulated substances, and real estate law. Ted’s interdisciplinary practice focuses on tax credits, regulations, risk management, and transactions that include private and public lenders, including joint ventures in partnership with tribally sovereign nations.

In his role, Ted advises a wide range of clients, including marijuana-related businesses, housing developers, nonprofits, lenders, Tribal Nations, businesses, and municipalities. For close to 30 years, Ted has been a trusted advisor to large and small companies, ranging from start-ups to large, long-established national businesses. He regularly advises clients on business sales and acquisitions, commercial loans, equity financings, real estate transactions, intellectual property issues, and many other transactional and contract matters.

Ted is widely recognized as one of New England’s preeminent business and regulatory lawyers for marijuana-related businesses. He counsels dispensaries, Tribal Nations, investors, landlords, property owners, and municipalities as they navigate the complex and rapidly-evolving landscape of cannabis law. Ted is often invited to speak about marijuana legal and business issues to civic and business groups.

Ted also has substantial experience using the federal Low Income Housing Tax Credit Program to develop affordable housing. Ted has successfully represented private and non-profit developers in the financing and construction of hundreds of units of affordable housing in Maine and New Hampshire. Ted also specializes in the use of historic rehabilitation tax credits and the New Markets Tax Credit Program.  With the recent enactment of the Inflation Reduction Act, he advises clients on tax credits that impact affordable housing and renewable energy.

Dedicated to serving community needs, Ted is Chair of the Zoning Board of South Portland, and serves as Treasurer for the Maine Humanities Council. He has also served in leadership positions with other community organizations, including Immigrant Legal Advocacy Project and Casa, Inc.
